The <br />comment arose out of the conditions that existed during the spring thaw and Bear Creek Fansite construction, and our <br />desire to see that Oxbow use of the road does not adversely impact the environment. This road is somewhat special, in <br />that it is pre-existing and private or BLM-owned, and does not truly fit into the Light Use or Access Road categories. <br />I forwarded your message to Jim Stark. The Division appears to be asking Oxbow to be-responsible for the operation, construction and <br />maintenance and post-mining conditions of the entire Bear Creek road. This is a road used by ranchers, hunters, gas <br />company trucks, etc. with which we have little control. For example, once the fansite is complete, during the 4 month fall <br />hunting season there are dozens of hunters traversing the road daily in all conditions at a time when Oxbow will have only <br />one maintenance truck using the road. <br />Likewise, we also have little control over Highway 133 that passes through our Permit area and it is also used by Oxbow <br />employees. We should discuss further what the Division has in mind for a PAP road discussion. <br />Under item 2. The Division proposes 11,908 bags of cement,-368 hours of drill rig time and 368 hours of water truck time <br />to fill the holes with cement. Instead, Oxbow and other local mines use cement trucks from local venders to simply drive <br />up to the borehole casing and unload into the borehole. We suggest the Division take another look at sealing boreholes in <br />a more efficient and cost effective manner. Is there some information we can provide to the Division to make the borehole <br />sealing project more reasonable? <br />We will be in touch. <br />James A.
