3.0 Environmental Protection Measures and Monitoring <br />. Required by Other Agencies <br />The following sections identify the environmental protection measures and <br />monitoring requirements by other agencies, and a list of permits and licenses. <br />3.1 Environmental Protection Measures and Monitoring by <br />Statute, Regulation or Permit <br />The Van 4 Mine complies with federal, state, and local laws and regulations. The Van <br />4 Mine is also consistent with Rangeland Health Standards and Guidelines and does <br />not affect any tribal lands held in trust for the tribes by the federal government. More <br />than three dozen federal environmental laws and regulations apply to various aspects <br />of mining at the Van 4 Mine. The following are the major laws governing mining. <br />¦ General Mining Law of 1872- provides Denison with a statutory right to <br />prospect and mine locatable minerals including uranium and vanadium on <br />lands open to mineral entry under the General Mining Law of 1872 such as the <br />Van 4 Mine. <br />¦ Surface Resources Act at 43 Code of Federal Regulations (CFR) Subpart 3715 <br />- regulates residency or seasonal occupancy of mining claims by mining <br />claimants and requires occupancy to be authorized by the proper BLM field <br />office through a notice or plan of operations. <br />• ¦ Federal Mining Law at 43 CFR Subpart 3809, Surface Management Program <br />- requires proper permits and authorizations for mineral exploration, mining, <br />and reclamation actions on the public lands administered by BLM. <br />¦ National Environmental Policy Act - requires federal agencies to use a <br />systematic interdisciplinary approach to decisions that may have a significant <br />effect on the environment. <br />¦ Federal Land Policy and Management Act - requires the prevention of undue <br />and unnecessary degradation of federal lands. <br />¦ Clean Air Act - establishes air quality standards and directs states to enforce <br />standards through development of a state implementation plan, which <br />includes emission limitations, permitting, and monitoring. <br />¦ Federal Water Pollution Control Act (Clean Water Act) - directs states to <br />establish use designations, anti-degradation policy, and water quality <br />standards for surface water; and establishes a permitting program to regulate <br />discharge of pollutants to surface water. <br />¦ Safe Drinking Water Act - directs standards to be set for quality of drinking <br />water supplied to the public (states are primary authorities) and regulates <br />• underground injection operations. <br />3-1 <br />T:\84988-Denison Mines\Task Order 4 - EPP Sunday Mines Group-Van4\Van4TlNAL Repon\FINAL - Environmental Protection Plan Van4.doc
