After the Court's approval of this Settlement Agreement, and before entry by <br />the Court of a quiet title decree and a declaratory judgment, Gunnison County shall obtain <br />a survey by a Colorado licensed surveyor to specifications determined by Gunnison <br />County and at the sole cost of Gunnison County, determining a center line legal description <br />of the Yule. Creek Access Road as it currently exists ,including but not limited to the <br />currently existing public parking area, over the subject property/. This center line legal <br />description and the width articulated in paragraph 8 above and a description of the existing <br />public parking area shall be incorporated into the quiet title decree and declaratory <br />judgment as the legal description for the Yule Creek Access Road as it crosses the subject <br />property. <br />13. The public, including but not limited to individuals using the road to obtain <br />access to private and public property in the area served by the road, is the intended <br />beneficiary of this Settlement Agreement. <br />14. Gunnison County, the Forest Service, GN1YA, Inc., and Sierra Nlinerals <br />Corporation shall pay their own respective costs and attorney's fees incurred in the above <br />captioned matter. <br />15. A facsimile signature to this document shall have the same effect and shall <br />be accepted the same as an original.
