The Mclnryres will consent to alloa Quarry and any necessary third parry <br />access to the McIntytes' Yule Lode to perform the neecasary repair work <br />under this agrccmant including. blasting; clearing debris; trail maintenance; <br />and, slurry removal, on the Mclntyrc property. This consent will be in efket <br />until) use 30, 2007; <br />2. The Parties agree that access to the damaged Katz will be cloned during tha <br />work, but agree that the trail must be reopened and usable by June 26, 2007; <br />3. The work to be performed under this agreement will be performed entirely at <br />Quarry's risk. Quarry assumes all responsibility for all services performed <br />under r4ris agreement, including services provided by Hurd parties, such as <br />blasting services. <br />4. Quarry assumes a1) responsibility for public safety during the work, Quan}' is <br />sole]y responsible for carrying any necessary public liability insurance, posting <br />any nteded signs and installing any necessary barricades to close the damaged <br />portion of the trail; <br />5. Quarry assumes all responsibility for public safety concerning the marble and <br />other Quarry debris remaining on the McIntyre property aftee compkrioo of <br />the work.
