The issuance of this permit <br />does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from <br />seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval <br />of a variance has been granted by the State Board of Examineis of Water Well Construction and Pump Installation <br />Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137(2) for the construction of a well, appropriating ground water tributary to the Colorado <br />River, on the condition that the well shall Ve operated only wheh the West Divide Water Conservancy District's substitute <br />water supply plan, approved by the State Engineer, is in effect,!and when a water allotment contract between the well owner <br />and the West Divide Water Conservancy District for the release of replacement water from Rued! Reservoir is in effect, or <br />under an approved plan for augmentation. WDWCO contract #050317FR(a). <br />4) The use of ground water, in addition to evaporation (198.28 AF), is limited to batch plant uses(1.99 AF), gravel and minting <br />losses (5.88 AF) and miscetlanous uses (1.0 AF) related to the:gravel pit operation. All uses of this well wilt be curtailed <br />unless the water allotment contract or a plan for augmentation is in effect. This well is known as SILT PIT, <br />5) The averago annual amount of ground water to be appropriated shall not exceed 207.14 acre-feet with the total surface <br />area of the proposed ground water pond limited to 73 acres. ': <br />6) The boundaries of the gravel pit pond shall be more than 600 feet from any existing well, completed in the same aquifer, <br />that is not owned by the applicant. <br />7) The owner shall mark the well in a conspicuous place with well hermit number(s), name of Die aquifer, and court case <br />number(s) as aopropdate. The owner shall take necessary means and precautions to preserve these markings. <br />8) This well shall be constructed not more than 200 feet from the location specified on this permit. <br />9) A totalizing How meter must be installed on this well and maintained in good working order. Permanent records of all <br />diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon <br />request. <br />10) Pursuant to Policy 2000-4 of the State Board of Examiners of Water Well Construction and Pump Installation Contractors <br />(Board), no pumping equipment shall be Installed in the gravel pit well to ywflnhnd,. w water for any beneficial use, unless a <br />separate written request for a variance has been approved by the Boart/Iy/I <br />APPROVED <br />MJV <br />Slate Engineer t By <br />Itr,Ceij?t No. 95026C-4 _ DATF.
