The conditional water rights described hereinei°ttirt?, tfhce and <br />effect until _ JANmn 2014 if the Applicant wishes to maintain the <br />conditional water rights thereafter it shall file an application for a finding of reasonable <br />diligence on or before that date, or make a showing on or before then that the <br />conditional water right have become absolute water rights by reason of the completion <br />of the appropriations. <br />10. The Application, as decreed herein, is administrable by the State and <br />Division Engineers. Review of determinations made by the Division Engineer or the <br />State Engineer in administration of the subject water rights and plan for augmentation is <br />a "water matter" which the Water Court may review under its exclusive jurisdiction. <br />11. Pursuant to Rule 9 of the Uniform Local Rules for All State Water Court <br />Divisions, upon the sale or other transfer of the subject conditional water rights, the <br />transferee shall file with the Division 5 Water Court a notice of transfer which shall <br />state: <br />A. The title and case number of these Case Nos. 05CW278 and <br />06CW 12 (consolidated). <br />B. The description of the conditional water right transferred; <br />C. The name of the transferor; <br />D. The name and mailing address of the transferee; <br />E. A copy of the recorded deed. <br />The owner of the said conditional water rights shall also notify the Clerk of the <br />Division 5 Water Court of any change in mailing address. The Clerk shall place any <br />notice of transfer or change of address in the case file of these Case Nos. 05CW278 and <br />06CW12 (consolidated) and in the case file in which the Court first made a finding of <br />reasonable diligence. <br />It is accordingly ordered that this ruling of Referee and judgment and decree <br />shall be filed with the Water Clerk and shall become effective upon such filing, subject <br />to judicial review pursuant to C.R.S. § 37-92-304, as amended. <br />It is further ordered that a copy of this ruling of Referee and judgment and <br />decree shall be filed with the State Engineer and the Division Engineer for Water <br />Division No. 5.
