GRAVEL PURCHASE AGREEMENT Owner of Gravel Purchaser of Gravel and Permit Operator Evelyn L. Ward Phillips County 2311 W. 18"' St. 221 S. Interocean Ave. Greeley, CO 80634 Holyoke, CO 80734 Evelyn Ward, owner of the gravel in the Ward gravel pit located in the NW1/4 of the NWl/4 of Section 31, T9N, R43W of the 6th P.M., Phillips County, Colorado hereby agrees to sell gravel to Phillips County. Phillips County, as the purchaser, hereby agrees to obtain a mining permit from the State of Colorado and act as the operator of the pit. The plan for reclamation of the pit is hereby approved by the owner as this agreement is ratified. Gravel will only be taken from the areas described in the permit unless both the owner and Phillips County agree to extend the area to be mined. Research indicates that surface ownership of this land is held by Evelyn Ward and that the mineral rights are owned by Evelyn Ward. Evelyn Ward hereby certifies that payment should be made to her at the aforementioned address. Claims for payment for gravel made by any other parties concerning this pit shall not be the responsibility of Phillips County. Phillips County agrees to pay .40 a yard for the gravel. This agreement is made for a period of 7 years and may be extended by mutual agreement or terminated with 6 months notice by either party. The property owner, Evelyn Ward, shall not be responsible for all of the gravel pit operations. Phillips County assumes full liability for gravel pit operations and covers them under their current liability policy.
