GRAVEL PURCHASE AGREEMENT <br />Owner of Gravel Purchaser of Gravel and <br />Permit Operator <br />Evelyn L. Ward Phillips County <br />2311 W. 18"' St. 221 S. Interocean Ave. <br />Greeley, CO 80634 Holyoke, CO 80734 <br />Evelyn Ward, owner of the gravel in the Ward gravel pit located in the NW1/4 of the NWl/4 of Section 31, T9N, <br />R43W of the 6th P.M., Phillips County, Colorado hereby agrees to sell gravel to Phillips County. <br />Phillips County, as the purchaser, hereby agrees to obtain a mining permit from the State of Colorado and act as <br />the operator of the pit. The plan for reclamation of the pit is hereby approved by the owner as this agreement is <br />ratified. <br />Gravel will only be taken from the areas described in the permit unless both the owner and Phillips County agree <br />to extend the area to be mined. <br />Research indicates that surface ownership of this land is held by Evelyn Ward and that the mineral rights are <br />owned by Evelyn Ward. <br />Evelyn Ward hereby certifies that payment should be made to her at the aforementioned address. <br />Claims for payment for gravel made by any other parties concerning this pit shall not be the responsibility of <br />Phillips County. <br />Phillips County agrees to pay .40 a yard for the gravel. This agreement is made for a period of 7 years and may be <br />extended by mutual agreement or terminated with 6 months notice by either party. <br />The property owner, Evelyn Ward, shall not be responsible for all of the gravel pit operations.
