(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1979-165 <br />INSPECTION DATE: May 21, 2009 INSPECTOR'S INITIALS: QR2 <br />OBSERVATIONS <br />This inspection was conducted by David Bird of DRMS as required for the Surety Release request submitted by the <br />Operator on 31 March 2009. The site is located in Adams County at 1-76 and East 72"d Avenue. Sand and gravel <br />are the commodities of interest at this site. Albert Frei & Sons, Inc. is both owner and operator of the property. <br />The Division holds a bond in the amount of $66,800 for the operation. Ben Frei of Albert Frei & Sons, Inc. and <br />Stevan O'Brian of Environment, Inc. were present representing the Operator. <br />The post-mining land use for this site is specified as industrial/commercial. The parcel east of the railroad line is <br />being leased by Brannon Sand & Gravel and includes construction material processing facilities such as an asphalt <br />batch plant, a concrete batch plant, concrete and asphalt recycling facilities, plus accessory uses including truck <br />parking, raw material storage, and equipment storage. This parcel appears to be in compliance with the approved <br />Reclamation Plan. <br />The western parcel however, is not as depicted in the Reclamation Plan Map that was submitted as part of <br />Technical Revision TR-02 on 10 October 2006. As shown on the attached photographs, the site is in need of <br />more thorough grading, contouring, and revegetation to bring the site into compliance with the approved <br />Reclamation Plan. After these activities have been performed, the Operator may resubmit a Surety Release <br />request.
