and General Electric Holdings, Inc. Page 2.03-17 states that the lease, which is listed as <br />Cyprus No. 52000, was for 320 acres. The lease was terminated on 25 March 2003. <br />The problem that the Division noticed when looking at the legal description on the lease <br />is that it does not match the legal description garnered from Map 2. The legal description <br />on Page 2.03-17 is as follows: <br />Township 5 North, Range 91 West <br />Section 4: SW'/ NW'/, W1/2 SW'/ <br />Section 5: E'/2 SE1/, SE'/ NE'/ <br />This legal description only encompasses 240 acres. The upper quarter, or 80 acres, of the <br />GE Holdings (Moffat County) lease area (described as Section 4: NW'/ NW'/; Section 5: <br />NE'/ NE'/) is missing from the legal description for the lease area on Page 2.03-17. <br />Further, the coal in this "missing" 80 acre parcel was at least partially mined in the E- <br />Seam in Section 5 and almost entirely mined in the F-Seam of both Section 4 and Section <br />5. There is no mention of this area in the legal descriptions of any of the other coal leases <br />listed in the Coal Leases portion of the permit (Pages 2.03-12 through 2.03-20). <br />Please check the Moffat County coal ownership on Map 2 - Coal Ownership and the <br />legal description of Cyprus lease No. 52000 shown of Page 2.03-17. Please correlate this <br />information with the original lease information to determine if an error was made in the <br />transcription of the legal description of the lease or the map depiction of the area.
