(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1995-0 7 <br />INSPECTION DATE: MAX 77 2009 INSPECTOR'S INITIALS: _DR? <br />OBSERVATIONS <br />This pre-operational inspection was conducted by David Bird of DRMS as required for the Conversion application <br />submitted by the Operator. The site is located in Park County about 3 miles southeast of Fairplay alongside State <br />Highway 9. Gravel is the commodity of interest at this site. The Operator's contact, Doug Keith, was notified <br />about the inspection but did not attend <br />Two problems were observed. First, the notice required under Rule 1.6.2(b) was not seen anywhere on the <br />premises. In order for the Conversion application to be designated as complete, the required notice must be <br />posted and photographic evidence of the posting must be provided to the Division. The Division cannot resume <br />processing of the application until the notice is posted and evidence of its posting is provided to the Division. <br />The second problem observed is that the site is apparently being used as a disposal/storage area for hazardous <br />materials, specifically automobile batteries, computer hardware, and tires. This in conflict with Colorado <br />Department of Public Health & Environment (CDPHE) Regulations for Hazardous Material management, and the <br />Division cannot allow a permitted mine site to be used as a refuse disposal area. Please contact the CDPHE <br />Hazardous Materials and Waste Management Division for information on how to dispose of or store these <br />materials, and copy DRMS on all correspondence.
