(Page 2) <br />MINE ID # OR PROSPECTING ID #: -ELI-19840 <br />INSPECTION DATE: 5/14/09 INSPECTOR=S INITIALS: MAC <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety. <br />Larry Chartier was also present for the inspection. The Chartier Pit is located approximately 2 miles north of <br />Brush, Colorado on the south side of the South Platte River. The site is permitted for 8.5 acres. <br />The Colorado Division of Wildlife (CDOW) has a perpetual easement over the pit for fishing, hunting and <br />recreation; several fishermen were present during the inspection. The site is operated on a limited basis; no <br />mining was taking place at the time of the inspection. The permit sign was posted at the site entrance per the <br />requirements of Rule 3.1.12. The northeast permit boundary marker could not be identified during the <br />inspection, please see Page 3 of this report for the required corrective action. <br />The Chartier Pit is roughly in the shape of a rectangle; mining is progressing to the east. The pit is unlined and <br />contains exposed groundwater. The CDOW has provided the Division with a copy of a current Substitute Water <br />Supply Plan from the Office of the State Engineer. All of the pit slopes have been graded to 3H:1 V, except for <br />the active mining front on the east end of the pit. The area around the pit has been self reclaimed and the native <br />vegetation is well established. The pit is approximately 6.5 acres in size, leaving an additional 2 acres of land <br />that can be disturbed. Mr. Chartier indicated that he wishes to expand the size of the pit beyond the permitted <br />acreage. The Division informed him that he can amend the permit to increase the affected acreage to 9.9 acres <br />under the current 110 Construction Materials Reclamation Permit. The permit may also be converted to a 112 <br />Construction Materials Reclamation Permit in order to expand the pit beyond 9.9 acres. <br />The Division currently holds a Financial Warranty in the amount of $1,639.00, which has been determined to be <br />sufficient to complete reclamation. <br />This concluded the inspection. <br />I & E Contact Address <br />NAME: Larry Chartier <br />OPERATOR: <br />STREET: 21305 Road 98-5 <br />CITY/STATE/ZIP: Brush CC) 80793
