III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the Hamilton Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS in May 2009. <br /> The field portion of the inspection occurred on Monday, 18 May beginning at 4:50 p.m. Weather <br /> conditions were clear and hot, with a light breeze. No representative of the operator was <br /> present during the inspection. <br /> Availability of Records <br /> • Permit records are stored at the nearby Broad Canyon Landfill office, and were <br /> inspected on the afternoon of 19 May. A completed DRMS Availability of Records form is <br /> included with this report. <br /> Sians and Markers <br /> • Rule 4.02.7 requires that where topsoil... is segregated and stockpiled..., the stockpiled <br /> material shall be clearly marked. No sign was observed marking the topsoil stockpile <br /> located immediately south of Pond B. All other topsoil stockpiles in the permit are clearly <br /> marked. <br /> Hydrologic Balance <br /> • Pond A and Pond B were both dry at the time of the inspection. <br /> • The V-ditch flowing into the southwestern corner of Pond B is well vegetated and stable <br /> with respect to erosion (Figure 1). <br /> • Culverts and ditches along the road to Mine Area 3 were clear. <br /> • A community of Whitetop is becoming well established at the eastern end of the <br /> impounding structure for Pond B(Figure 2). <br /> Topsoil <br /> • The topsoil stockpile at Pond B is well vegetated with a variety of desirable species, <br /> including: sagebrush; rabbit brush; four-wing salt bush; prickly pear cactus; snakeweed; <br /> scarlet globemallow;slender wheat grass; loco weed; and Indian rice grass. <br /> • Numerous thistle rosettes (Figure 3)were observed along the southern slope of the Pond B <br /> topsoil stockpile, increasing in density to the east (Figure 4). No skeletons from previous <br /> years' growth were observed; these should be treated this year in accordance with the <br /> approved Weed Control Plan, so that further establishment is prevented. <br /> Fish 8. Wildlife <br /> • A single mule deer was sighted at Pond A. <br /> • A collared lizard was seen in the wood pile at the southeastern corner of Pond B. The <br /> lizard was in full breeding color (Figure 5). <br /> Reveg_etation <br /> • Numerous thistle plants were flourishing at the intersection of the main haul road and the <br /> turnoff to Mine Area 3. <br /> Hamilton Mine C-1991-078 18& 19 May 2009 <br />
