(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2004-084 <br />INSPECTION DATE: 5/13/2009 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS THM <br />This inspection was conducted as part of the normal monitoring program established by the Colorado Division of <br />Reclamation, Mining and Safety. The Benson Brothers Pig Mesa Pit is located off of Fairview Road approximately <br />4 miles northeast of Delta, Colorado. The Benson Brothers Pig Mesa Pit is a 39 acre, 112c surface operation. <br />Edward Benson of Benson Brothers accompanied the inspector during the inspection. <br />The mine identification sign and the affected area boundary markers are in place and in compliance with rule 3.1.12. <br />The sign is located on the fence at the main entrance on the west side of the gravel mine. The permit boundaries are <br />comprised of fence posts that are easily identifiable around the entire perimeter of the mine. <br />The pit is currently active. Various pieces of heavy equipment were observed working stockpiles, loading trucks <br />with material and feeding a portable crusher. Stockpiles of used asphalt intended for recycling were noted to be <br />along the eastern perimeter of the permit area. This is seen as a problem and a revision to the mine plan to account <br />for the importation of offsite materials must be completed in order for this practice to continue. An estimate of the <br />maximum cubic yards of the recycled asphalt must accompany the revision so that removal or burying of the <br />stockpile can be accounted for in the reclamation cost estimate. <br />Adequate amounts of topsoil and overburden appeared to be stockpiled for the permitted reclamation plan. Large <br />stockpiles of material were present during the inspection. No evidence of major storm water erosion was noted. <br />The most recent excavation of construction materials is in the southwestern portion of the permit area. The high <br />wall in this area was approximately 30-40 feet in height and approximately 300 feet across. <br />In an effort to ensure the financial warranty remains adequate to reclaim this site per the requirements of the <br />approved reclamation plan, DRMS will update the reclamation cost estimate. The estimate will be forwarded to the <br />operator under separate cover.
