Cattany <br />Grand Junction, Colorado 81501 Division Director <br /> Natural Resource Trustee <br />Re: Munger Canyon Mine (Permit No. C-1981-020) <br />Portal Backfill Plan <br />Dear Mr. Stover: <br />The Division of Reclamation, Mining, and Safety (DRMS) has reviewed CAM Mining, <br />LLC's (CAM's) proposed portal backfill repair plan for the Munger Canyon Mine. The <br />DRMS noted the crack/opening at one of the portal entries during our Phase I bond <br />release inspection conducted on December 3, 2008 and requested that CAM repair the <br />sloughing at the former portal site. The DRMS reiterated our concem about the portal <br />opening in our May 13, 2009 complete inspection report and requested that CAM prepare <br />a plan to properly fill the opening in a manner that will prevent future surface collapse. <br />The DRMS has received CAM's proposed plan for repairing the portal entry in your <br />letter dated May 20, 2009. As proposed, Versa Foam System 15 will be sprayed into the <br />portal void. The outby section of the portal void will be filled with foam to provide a <br />back stop for dirt fill. The foam will be plated with nine to twelve inches of dirt and <br />rock. <br />CAM's portal backfill repair plan is hereby accepted. Please ensure that the work is <br />completed with minimal disturbance to established revegetation. As stated in your letter, <br />the repairs will be complete by the end of June 2009 or 30-days after plan approval. <br />Please call if you have any questions. <br />Sincerely, <br />"If <br />- 4-vil P. <br />Michael P.
