Cattany <br />Oak Creek, CO 80467 Division Director <br /> Natural Resource Trustee <br />Re: Foidel Creek Mine, Permit No. C 1982-056, MR237 adequacy concerns <br />Dear Mr. Nettleton: <br />The Division has reviewed Twentymile Coal Company's (TCC) application for a minor revision, MR237. <br />This revision proposes to install a sump and culvert at the Pond B access road ramp, and replace the <br />piping from the west cell of the Fish Creek Borehole pond and site 115. Although the Division is in <br />agreement with the content of the revision, the Division has identified problems with placement of the <br />revised test into previously approved permit text: <br />Revised page 2.05-50a, fits into the approved permit pages with no difficulty. <br />Revised permit page 2.05-81 does not fit with approved pages from TR66 (4/11/2009). Please renumber <br />revised page 2.05-81 to 2.05-84.1. A portion of the first paragraph "Warehouse Area No. 2" will be <br />duplicated from the bottom of approved page 2.05-84 (4/11/2009), but no text will be lost. <br />Following, revised page 2.05-82 (5/21/2009) will need to be renumbered to 2.05-84.2, and revised page <br />2.05-83 will need to be renumbered to 2.05-84.3. However, this change looses the last paragraph from <br />approved page 2.05-84.3 (4/11/2009) that discusses "Northwest Mains Ventilation Shaft and Thickener <br />Underflow Project". <br />With these corrections, the Division has no other concerns regarding MR237. The Division agrees with <br />TCC's reclamation cost estimate for this revision.
