Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article <br />33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on March 24, 2008, an application to <br />renew an existing permit to conduct coal mining operations at the Elk Creek and Sanborn Creek Mine was <br />considered complete for the purposes of filing. All review and comment periods as provided in the <br />Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. <br />Oxbow Mining, LLC proposes to continue Underground coal mining and/or reclamation operations on land <br />located approximately 0 miles North of Somerset, Colorado. The permit area is further described as <br />follows: <br />Portions of Section 31, Township 12 South, Range 90 West; <br />Portions of Sections 34, 35 and 36, Township 12 South, Range 91 West; <br />Portions of Sections 1, 2, 3, 4, 5, all of 6 and 7, Portions North of the North Fork of the Gunnison River in <br />Sections 8, 9, 10, portions of Sections 11, 12, and 17, Township 13 South, Range 90 West; <br />Portions of Sections 1-3, 11-13, Township 13 South, Range 91 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Somerset and <br />Bowie. <br />In Permit Renewal No. 5, Oxbow Mining, LLC has applied for a renewal of their Elk Creek/Sanbom Creek <br />coal mining and reclamation permit for another five year term. The permit renewal application would not <br />incorporate additional lands into the permit area or alter previously approved permit conditions or <br />mitigation measures. <br />This permit renewal application is available for review at the Delta County Planning Department, 501 <br />Palmer Street, Delta, CO 81416, at the Paonia Public Library, 140 Grand Avenue, Paonia, CO 81428, at the <br />Gunnison County Planning Department, 221 North Wisconsin Street-Suite D, Gunnison, CO 81230, and at <br />the Division office. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
