11. At the bridge crossing, Consentee agrees to maintain the O&M road surface so as to minimize <br />erosion on the downstream side of the O&M road and canal bank If erosion does occur, ?, <br />Consentee agrees to repair such damage in a timely manner. The CIAP's crossing both O&M <br />roads must be placed so as the road will remain flat, such that no humps are created and <br />prevent erosion from vehicle traffic or water flowing across the O&M road. <br />12. Traci caution signs indicating that the bridge is a large truck crossing are to be placed 50 feet <br />on each side of the Consentee's bridge. <br />13. For safety, a clear line of sight will be maintained by Consentee. Consentee will be <br />responsible for removal of shrubs, trees, and brush along the bridge and Canal as agreed upon <br />by C:onsentee and Company. <br />If the above conditions are not followed, Reclamation may pursue legal action to halt crossing the <br />Canal and O&M road rights-of-way until such time that the conflict between Reclamation's enjoyment <br />of its senior easement and the Consentee's actions are resolved. Additionallly, if the Consentee's <br />activities cause injury to the Canal or appurtenant features and facilities in Auding the O&M road, the <br />Consentee agmes to correct all injuries to the satisfaction of Reclamation oz Reclamation may seek full <br />and just compensation. <br />This Letter of Consent will become effective immediately on its execution by Reclamation and shall <br />inure to the benefit of and be binding upon the heirs, executors, administrators, and assigns of the <br />Consentee mid the assigns of Reclamation, the Company and the District. <br />We request that you, as Consentee, indicate your acceptance of the above conditions by signing in the <br />space provided on the original letter and returning it to this office.
