The Issuance of this permit does not <br />ensure that no injury will occur to another wasted water right or preclude another owner of a vested water right from seeking relief in a civil court <br />action, <br />2) The construction of these gravel pit wells shall be in compliance with the Water Well Construction Rules 2 OCR 402-2, unless approval of s <br />variance has been granted by the State Board Of Examiners of Water Well Construction and Pump Installation Contractors in accordance with <br />Rule 18. <br />3) Approved pursuant to CRS 37-90-137 (2) and (1 t) for wells (gravel pit ponds) in accordance with the augmentation plan approved by the <br />State Engineer on January 17, 2005, for the Casey Ponds No. 1, 2. 3. 4, 8 5, Division of Minerals S Geology Permit Number M-1979349. The <br />wells (ponds) shall not be operated unless they are included in the plan for augmentation approved by the Water Court as Identified in Case <br />no. 03CW 188. <br />4) These gravel pit wells are sub)ect to administration by the Division Engineer, In accordance with applicable decrees, statutes, rules, and <br />regulations. The gravel pit wells are known as Casey Ponds No. 1, 2, 3, 4.8 5 as described In Case No. 03CW186. <br />5) The average annual amount of ground water to be appropriated shall not exceed 11.21 acre-feat per year upon completion of Phase 1, <br />26.97 acre-feet per year upon completion of Phase 2 and 56.68 acre feel per year upon the completion on Phase 3 and mclumatlon with the <br />total surface area of the proposed ground water wellsiponds limited to 18.7 acres in accordance with the augmentation plan In the decree <br />Case No.03CW 186. <br />6) The use of ground water, in addition to evaporation of 56.68 acre feet per year upon completion of the mining operations, is limited to <br />Industrial Including, but not limited to, product moisture losses of 7 acre feet per year, dust suppression and agregate washing of 3.53 acre <br />feet: all In connection with the mining of send, gravel and related products, and recreation, wildlife and equatie habitat In connection with <br />reclamation as prescribed In Case no. 03CW188. No other use of water Is allowed unless a permit therefor is approved. <br />7) The owner shall mark the well (gravel pit pond) in a conspicuous place with well permit number(s) and court case number(s) as appropriate. <br />The ownait shall take necessary means and precautions to preserve these markings. <br />8) A totalizing flow meter most be lnstalled 90 as to measure any pumping from this gravel pit pond and maintained in good working order. <br />Permanent records of all diveraleni from the gravel ph pond, tonage of mined product and the surface area of ground water exposure shall be <br />maintained by the well owner (recorded at least annually) end submitted to the Division Engineer upon request. <br />9) Pursuant to Rule 10. 1.6 of the Water Well Construction Rules, gravel pit wells are exempt from the minimum well construction standards <br />except for contamination considerations as stated In the Rule. The owner of the gravel pit shall take necessary means and precautions to <br />prevent contaminants from entering the gravel pit well. <br />10) Pursuant to Rule 17.1.4 of the Water Well Construction Rules, this owner shall submit, after initiation of construction, site plan and cross <br />section drawings on 8-112" x 11" paper showing the extent of Intended excavation, the maximum depth of the pit, and the Initial static water <br />level.
