May 20, 2009 <br />Mr. Peter Foster <br />Wright Water Engineers, Inc. <br />1666 N Main Avenue, Suite C <br />Durango, CO 81602 <br />RE: Olathe Pit, Substitute Water Supply Plan <br />DMG File No. M-1984-108 <br />Section 22, T55N, R10W, NM P.M. <br />Water Division 4, Water District 41, Montrose County <br />Approved from April 1, 2008 through March 31, 2010 <br />Dear Mr. Foster: <br />This letter is in response to the application submitted in April 2008 requesting a <br />substitute water supply plan (SWSP) for a sand and gravel pit to be operated by Western Gravel <br />Incorporated ("Applicant") in accordance with Section §37-90-137(11), C.R.S. The applicant <br />shall be responsible for compliance with this plan, but the State Engineer's Office may also <br />pursue the landowner for eventual compliance. The required fee of $1,593 for the substitute <br />water supply plan has been paid. <br />Plan of Operation <br />This plan describes the proposed water consumption for the period of April, 2008 through <br />March, 2010. The South Pit will be dewatered and mined for up to 3 months out of the year. <br />Water will be pumped into a settling pond then diverted through wetlands and into the North Pit <br />before being released to the Uncompahgre River. After mining each year, the South Pit will be <br />refilled with water. Up to 6.8 acres of groundwater may be exposed within the permit area. <br />Approval is granted through December 31, 2009. <br />Depletions <br />You have provided a monthly breakdown of the annual depletions at this site in your <br />attached Table 2. The table shows that during the period of April 2008 through March 2009 the <br />total stream depletions are estimated to be 58.4 acre-feet. The amended Table 2 shows that <br />during the period of April 2009 through March 2010 the total stream depletions are estimated to <br />be 62.8 acre-feet, including the annual refilling of the pit. Depletions accrue to the <br />Uncompahgre River instantaneously as the pits are located within 100 feet of the river. The <br />estimated depletions are based upon groundwater evaporation, water in mined product, dust <br />control, and water filling the South Pit after annual mining is complete. No groundwater will be <br />used for concrete production, reclamation, or any other purpose. No ground water was exposed <br />within the permit boundary prior to January 1, 1981. No phreatophyte credit has been applied to <br />this plan.
