The responses follow the questions and are preceded by an <br />asterisk. <br />1. I believe the pages of the West Elk Mine permit that (at this stage) are to be revised are 2.05-15, 2.05-16, <br />2.05-17, 2.05-28, and 2.05-29. Please let us know if our list agrees with MCC's list. If the revised permit <br />pages requested in the first part of this e-mail changes this list, let us know that as well. <br />* The permit pages that were changed included pages 2.05-25 and 2.05-26 for the field-designed light-use <br />road, and pages 2.05-28 and 2.05-28a for the new monitoring, sampling, drilling and other temporary <br />facilities or operations discussions. <br />2. MCC should propose a method to incorporate the May 5, 2009 Barr Engineering Memorandum (and its <br />accompanying two Figures) from Paul Swenson, Jed Greenwood, and Brad Dunn to Chris Nyikos and <br />yourself into the West Elk Permit. This could be done by submitting the memo as a new Exhibit to the <br />permit, or a new Appendix, or some other such new addendum. Please let us know how this memo and its <br />two figures will be incorporated into the West Elk Permit, and provide any necessary cover/title page that <br />might precede the memo in the Permit. <br />* In response to a similar question in the Mid-term #6 permit review, MCC has agreed to add similar <br />approved minor or technical revision documents to Volume 11A-C of the permit document. The TR-117 <br />(MT-6 Responses) Table of Contents pages have been corrected for submittal in a separate document (re: <br />TR-117) to refer to the past thermal event and past and future MDW, geotechnical borehole and <br />miscellaneous approved (MR/TR) documents as Exhibit 80 in Volumes 11A-C of the permit. A reference <br />to Exhibit 80 has been added to both discussions provided in the attached revised permit pages. <br />3. I believe the proposed acreage for new disturbance is 0.6 acres, all on private land, with no increase in <br />permit area. Please let us know if these statements are correct. <br />* The proposed estimated disturbance is 0.6 acres
