III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site is currently completing the final <br />stages of reclamation of disturbed areas. Ground conditions were wet in places due to a rain <br />shower the previous evening. The weather was clear and breezy. Ron Thompson of Peak <br />Project Management represented the operator during the records inspection. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report. The insurance certificate now <br />shows an expiration date of February 2010. <br />Hydrologic Balance <br />All ponds remain dry with the exception of Pond 5, which held water at about the 50% level. <br />The sump above pond 8 held a small amount of water. Limited rainfall occurred the previous <br />evening but produced little storm runoff. <br />Ditches, noted in last month's inspection at the base of the steep north-facing slope, still <br />require cleanout. Please complete this maintenance work prior to the next State inspection. <br />Backfilling and Grading <br />The sediment storage area west of pond 9 has been recently regraded, reseeded, and <br />mulched.
