III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 19 May 2009. The weather was clear and the ground <br /> was dry during the on-the-ground inspection of the site. Graham Roberts of TMI accompanied the <br /> inspection. <br /> Trapper continues to progress with mining in the F-Pit and Z-Pit. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were inspected at the Trapper Mine site. <br /> Signs and Markers <br /> Mine ID and Blasting signs were displayed in the locations required. All required information was <br /> properly displayed at the time of the inspection. Topsoil markers and Permit Boundary markers <br /> inspected are delineated with a piece of PVC pipe attached to a T-post with either a P for permit <br /> boundary or T for topsoil. The topsoil markers and permit boundary markers observed were in good <br /> condition and displayed in the appropriate locations. All signs and markers were in compliance with <br /> Rules 4.02.2, 4.02.6(3) and 4.02.7 at the time of the inspection. <br /> Roads <br /> All haul roads were dry and being watered at the time of the inspection. All haul road side ditches <br /> were functioning as permitted at the time of the inspection. Adequate runoff was noted with no signs <br /> of damage or erosion. Access roads were dry with full access. All access roads appeared to be <br /> stable with no damage noted with the exception of the following: <br /> • The west side of the middle flume pond access road and the junction where the three access <br /> roads converge continues to be extremely rutted at the time of the inspection. When weather <br /> permits, these access roads will require grading in order to provide adequate runoff from the <br /> road. <br /> Hydrologic Balance <br /> Ponds were being monitored by Graham Roberts of TMI during this inspection. Four ponds were <br /> discharging during the inspection. <br /> • No Name appeared stable with no problems noted. No Name contained water and had a <br /> discharge rate of .15. <br /> • Middle Flume contained water and was discharging through the 1" Baski flume at .52 and pH <br /> at 8.8 at 16 degrees. <br /> • Johnson contained water with discharge at .08 and pH at 8.6 and 3270 conductivity. <br /> • East Pyeatt was discharging at the combined monitoring point at 0.82 with a pH of 7.7. The <br /> spring at East Pyeatt had a discharge of 0.50 through the 1" Baski flume. <br /> All pond embankments were stable with no problems noted at the time of the inspection with the <br /> exception of the following. All combination spillways were in compliance at the time of the inspection. <br /> • A large inlet delta at the east side inlet of Middle Flume has formed. This delta should be <br /> addressed and be cleaned out to maintain the integrity of the pond. <br />
