We are requesting the abandonment of our current sediment pond that is <br />located in part of phase 1 and part in phase 12. We propose to construct three (3) 35 feet wide X <br />400 feet long sediment ponds that will be inter connected by a buried steel pipe and located in <br />phase 7. <br />The flow of the process water will flow out of the No. 3 sediment pond and flow by open ditch to <br />discharge point 002A into Little Dry Creek. This point of discharge point is as per approval of <br />the Colorado Department of Public Health and Environment permit No. COG-500000, Facility <br />Number COG-500438. The sediment pond that is being abandoned is flowing to the same <br />discharge point as the proposed new relocated sediment ponds. <br />As per our current substitute water supply plan as approved by the State Engineers Office there is <br />allocated 2.73 acres of water surface exposed. By abandoning the sediment pond in our current <br />mining plan and relocating the sediment ponds to phase 7 we will not exceed 2.73 acres of <br />exposed water surface. <br />We do not anticipate changing the sequence of our present mining plan, which includes phase 1 <br />thru phase 13. Currently we are mining in phase No. 1, No. 2, No. 3, No. 4 and No. 5. We <br />propose to relocate the sediment ponds to phase No. 7. We are planning in the near future to <br />begin mining in phase No. 6 also. <br />A phased and cumulative bonding approach was approved in Technical Revision No. 3. They <br />are as follows for the first seven phases. <br />1. Phase 1 - $312,044.00 <br />2. Phase 2 - $101,812.00
