• 9.0 Administrative Review and Appeal Opportunities <br />If you do not agree with this decision and believe you will be adversely affected by it, <br />you may request a State Director Review or appeal to the Office of Hearings and Appeals <br />as described below. <br />A. State Director Review <br />In accordance with 43 CFR 3809.800, you may request a State Director Review <br />of my decision for this project. This request must be in writing, and received by <br />the State Director's Office no later than 30 calendar days from the date of this <br />decision. The State Director review request must be filed in accordance with 43 <br />CFR 3809.805 <br />The request should be sent to: <br />Colorado State Director <br />2850 Youngfield Street <br />Lakewood, Colorado 80215-7076 <br />This decision will remain in effect while the State Director Review is pending, <br />unless a Stay is granted by the State Director. If you request a Stay, you have the <br />burden of proof to demonstrate that a Stay should be granted. <br />The decision of the State Director may then be appealed to the Office of Hearings and <br />Appeals in accordance with 43 CFR 3809.809. <br />If the State Director does not make a decision on your request for review of this decision <br />within 21 days of receipt of the request, you should consider the request declined and you <br />may appeal this decision to the Office of Hearings and Appeals, Interior Board of Land <br />Appeals. You may contact the Colorado BLM State Office to determine when BLM <br />received the request for State Director Review. You have 30 calendar days from the end <br />of the 21 day period in which to file your Notice of Appeal. The appeal must be <br />submitted in accordance with the procedures listed below under "Appeal to Office of <br />Hearings and Appeals". <br />B. Appeal to Office of Hearings and Appeals <br />You may also bypass the State Director review and directly appeal the decision to the <br />Office of Hearings and Appeals (OHA) under 43 CFR 3809.801 - 43 CFR 3809.802 <br />Any Notice of Appeal must be postmarked or received within 30 calendar days of this <br />decision by: <br />Mark Stiles <br />Field Office Manager <br />San Juan Public Lands Center <br />15 Burnett Court <br />Decision Record 7 Sunday Mines Complex Expansion <br />Dolores Public Lands Office January 2009
