Since access would be restricted on the <br />Sunday Mine Complex to authorize personal only, it is reasonable to assume that no <br />members of the public would be around the vent holes. <br />In addition, Section 8.3.1.1 also explains Denison's dust control measures, which are in <br />compliance with the Mine Safety and Health Administration (MSHA), to minimize the <br />amount of dust that would be generated at the site. Denison has applied for and received <br />the necessary air permits from the Colorado Department of Public Health and <br />Environment (CDPHE). These air permits cover all fugitive emissions that may be <br />associated with the mine and vehicle traffic. CDPHE has determined that Denison is in <br />compliance with Ambient Air Quality Standards (AAQS). <br />I received a comment expressing a concern over potential effects to surface and <br />groundwater quality, particularly related to possible leaching from the waste rock area. <br />As shown on page 1 and 2 of this decision, I have added the following Conditions of <br />Approval in response to this public comment. <br />? Denison must provide monthly reports on the status of the WRA <br />characterization and geohydrologic studies, and fate and transport models <br />to the BLM. <br />? Composite samples would be made from quarterly waste rock grab <br />samples, and analyzed once per year to ensure the waste rock is still <br />considered inert. Denison must submit the data and a summary report to <br />the BLM on an annual basis. <br />? If characterization studies indicate the waste rock material is not inert, . <br />Denison must submit a monitoring plan to the BLM for approval. <br />? Denison would provide quarterly reports on monitoring data from all <br />groundwater monitoring wells. Water quality would be tested for any <br />potential leachates that are identified in the characterization tests. An <br />annual summary report would be submitted to the BLM <br />The Colorado Department of Transportation (CDOT) expressed concern over the increase <br />in traffic and increased wear and tear on the state highway that would result from this <br />proposed action. Since then, Denison has been working with CDOT and San Miguel <br />County to negotiate proper permitting and use of the roads. As a result, I am requiring <br />Denison to continue to work with CDOT and San Miguel County to ensure all road use <br />by Denison is in accordance with county and state laws and regulations. As part of the <br />compliance with CDOT, Denison will perform a traffic study per CDOT protocols to <br />determine appropriate mitigation of their concerns. <br />Some other concerns were raised during the comment period related to public radiation <br />exposure from. the transportation of uranium ore on public roads and highways. In <br />response to this comment, I have had more information incorporated into the EA <br />regarding potential public exposure. Several additional exposure scenarios have been <br />incorporated into the Transportation section of the EA. These exposure scenarios were <br />developed by the Department of Energy for their Uranium Leasing Program Final <br />Programmatic Environmental Assessment (DOE/EA-1535), dated July 2007.
