The number of trips shall be limited to a maximum of 34 haul trucks per day. <br />6. Hauling can occur from 7:30 AM to 11:30 PM Monday through Friday with an <br />occasional Saturday. Hauling may begin at 5:30 AM during the summer months <br />of June, July and August. <br />7. No hauling would be allowed on Saturdays in April, May, or June in those years <br />when there are sufficient releases from the McPhee Dam that allow boaters and <br />rafters to run the Dolores River releases where there would be increased use of the <br />BLM boat launch accessed from this same County Road. <br />8. The applicant agrees to comply with the posted speed limits on CR 20R. <br />9. This Special Use Permit and all amendments will be reviewed by the Board of <br />County Commissioners in one year to determine the applicant's compliance with <br />all conditions of approval. <br />10. Unless modified by this motion all CPC Resolution 1997-18 and BOCC <br />Resolution 2007-34 conditions of approval shall continue to apply to this Mining <br />and Mineral Processing Special Use Permit issued as a Conditional Use on <br />Federal Land. <br />11. All written representations of the applicant, in the original submittal and all <br />supplements, are deemed to be conditions of approval, except to the extent <br />modified by this Motion. <br />BE IT FURTHER RESOLVED that Pursuant to Land Use Code Section 5-1004 N. M. <br />a violation or noncompliance with any Special Use Permit or applicable Land Use Code <br />requirement may result in suspension and/or revocation of the Permit by the Board of <br />County Commissioners (BOCC) following a duly noticed public hearing, held with <br />no less than fifteen days prior written notice to the permittee, upon the BOCC <br />determination that there is competent evidence of such alleged violation or non <br />compliance. <br />BE IT FURTHER RESOLVED that this Special Use Permit and any amendments will <br />be reviewed by the Board of County Commissioners in one year to determine the <br />applicant's compliance with all conditions of approval. <br />BE IT FINALLY RESOLVED that all written representations of the applicant, in the <br />original submittal and all supplements, are deemed to be conditions of approval, except to <br />the extent modified by this Resolution. <br />BOCC Resolution 2008-41/Page 5 <br />
