404624 11-12-2008 09:41 AM Page 2 of 6 <br />• <br />(8.6 miles of county maintained raid); <br />WHEREAS, in an October 1, 2008 memorandum, County Road Superintendent Mike <br />Homer provided the following conditions should the BOCC approve the Amendment to <br />Resolutions CPC 1997-18 and BOCC 2007-34: <br />1. The Road Department will allow Denison Mines, or its contractor, to crush <br />raw gravel material in the Klondike Gravel Pit for exclusive use on CR 20R. <br />The raw material must be mined and processed in accordance with the Road <br />Department mining plan approved by the Division of Reclamation, Mining <br />and Safety. A site visit will be required with the crushing contractor and <br />District Supervisor before any work occurs in the Klondike Pit. All crushing <br />activity in the Pit must cease by November 2& with all crushing equipment <br />removed from the site by December 1. <br />2. All material crushed must be used on CR 20R. No private use of County <br />gravel will be permitted. <br />3. All mining, crushing and hauling costs are the responsibility of Denison <br />Mines. If approved by the BOCC, the Road Department will provide a motor <br />grader to spread material and a compactor. Denison Mines must provide <br />water during placement of gravel. <br />4. Denison is proposing to gravel 8.6 miles of CR 20 R from State Highway 141 <br />to the mine complex. The Road Department will spread gravel at least 4" <br />deep from existing shoulder to existing shoulder. No width changes are <br />planned for DR 20R with the exception of one eroded location. • <br />5. All gravel material crushed must meet CDOT Class 6 Base Specifications and <br />the County reserves the right to perform gradation tests to verify compliance <br />with Class 6 specifications. <br />6. Denison Mines, or its contractor, will provide a water truck or trucks while the <br />County is spreading and compacting gravel. <br />7. Denison Mines will either treat the newly graveled road with dust suppressant <br />or water the road to prevent gravel loss anytime trucks are hauling; <br />WHEREAS, the Sunday Mine Complex is located in the Big Gypsum Valley on public <br />lands administered by the BLM. These mines are located within the County's West End <br />(WE) Master Plan Area and in the WE Zone District. However, because the Sunday Mine <br />Complex is on-public land administered by the BLM the previously approved "Special <br />Use Permits" have been processed and reviewed in accordance with Land Use Code <br />Section 5-11 Conditional Uses on Federal Lands together with Section 5-16 Mining; <br />WHEREAS, the San Miguel County Master Plan for the West End concerning Natural <br />Resources, Agriculture and Recreation 5-2A states its goals is "to develop San Miguel <br />County's natural resources upon which the economy is based for mining, agriculture and <br />recreation in a manner that maintains the living quality of the environment for its <br />citizens"; <br />WHEREAS, the County Attorney has advised that this application is to be reviewed <br />8000 Resolution 2008-41/Page 2 <br />•
