The <br />appellant has the burden of showing that the decision appealed is in error. If all your <br />reasons were fully stated in the Notice of Appeal, no additional statement is necessary. <br />Appeals must meet current requirements of 43 CFR 3809.802. An appeal may be <br />accompanied by a petition for a stay of the decision in accordance with 43 CFR 4.21. <br />Under 43 CFR 3809.803, this decision goes into effect immediately and will remain in <br />effect during any appeals pending before IBLA, unless IBLA grants a stay under 43 CFR <br />4.21. The requirements for a petition for a stay of a decision are listed in 43 CFR 4.21(b) <br />If you wish to file a petition pursuant to regulations 43 CFR 4.21 for a stay of the <br />effectiveness of this decision during the time that your appeal is being reviewed, <br />the petition for a stay must accompany your Notice of Appeal. The relative harm to the parties if the stay is granted or denied, <br />2. The likelihood of the appellant's success on the merits, <br />3. The likelihood of immediate and irreparable harm if the stay is not <br />granted, and <br />4.
