414624 11-12-2008 09:41 An Page 4 of 6 <br />• <br />Uses on Federal Land and 5-16 Mining in particular meeting LUC Standard 5-1604 <br />Traffic Impacts and Highway Access, that the proposed operation will not exceed the <br />carrying capacity of the surrounding road, street and/or highway; <br />WHEREAS, Planning staff recommends approval of the amendments with the <br />understanding that the applicant will obtain a County Road & Bridge Special <br />Construction Permit and complies with the County Road Superintendent's comments and <br />conditions as stated in his October 1, 2008 memorandum; <br />WHEREAS, it is staff's recommendation that there be a condition that the applicant is <br />allowed to haul a maximum of 34 loads of mined material per day on CR 20R and not use <br />the average truck loads per day language. The condition would state that the hauling <br />would occur Monday thru Friday with hauling on an occasional Saturday, and specify the <br />hours. The current condition and approval refers to 7:30 am to 11:30 pm. as the allowed <br />hauling hours. Consideration should be given to allowing hauling to occur earlier in the <br />morning in the summertime. The BOCC may also want to consider a condition similar to <br />that applied to the Suckla Gravel Pit approval that the applicant may haul occasionally on <br />Saturdays except no hauling would be allowed on Saturdays in April, May, or June in <br />those years when there are sufficient releases from the McPhee Dam that allow boaters <br />and rafters to run the Dolores River releases where there would be increased use of the <br />BLM boat launch accessed from this same County Road; <br />WHEREAS, the Board of Commissioners of San Miguel County, Colorado considered <br />the alleged violations, along with relevant evidence and testimony from the public, at a <br />Public Hearing on October 22, 2008 and November 5, 2008. • <br />NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners of <br />San Miguel County Colorado, unanimously approve an Amendments to CPC Resolution <br />1997-18 and BOCC Resolution 2007-34 finding it meets LUC Sections 5-11 Conditional <br />Uses on Federal Land and 5-16 Mining in particular meeting LUC Standard 5-1604 <br />Traffic Impacts and Highway Access, that the proposed operation will not exceed the <br />carrying capacity of the surrounding road, street and/or highway. <br />BE IT FURTHER RESOLVED that this approval is subject to the following <br />conditions: <br />1. Complying with the County Road Superintendent's comments and conditions in <br />his October 1, 2008 memorandum and obtaining a Road & Bridge Special <br />Construction Permit. <br />2. The applicant will gravel CR 20R as stated in the County Road Superintendent's <br />Oct. 1, 2008 memorandum. <br />3. Providing a "Plan of Operation" approved by the BI-M. <br />BOCC Resolution 2008-41/Page 4
