County access permits and attributes therein, are obtained regarding access ?• <br />between county Road 20R and State Highway 141. <br />2.0 Finding of No Significant Impact (FONSI) <br />Based upon my review of the EA, I have determined that the proposed action, as <br />modified through conditions of approval and specific requirements in this decision, will <br />have no significant effects on the quality of the human environment. Therefore, an <br />Environmental Impact Statement is not necessary to further analyze the effects of the <br />proposed action. This finding is based on my evaluation of the context and intensity of <br />the reasonably foreseeable effects of the proposed action, as described in the attached <br />FONSI. <br />3.0 Alternatives Considered <br />Two alternatives were analyzed in the EA, the No Action Alternative and the Proposed <br />Action. <br />A. No Action Alternative - Under this alternative the proposed action, as <br />described on pages 3-7 of the EA would not occur. However, the existing mine <br />would continue to operate, without expansion. <br />B. Proposed Action - Under this alternative, the proposed expansion, <br />installation of vent holes, and exploration drilling would occur, as described on <br />pages 3-7 of the EA. Under this alternative, the existing mine would continue to • <br />operate. <br />4.0 Rationale For My Decision <br />I have determined that the proposed action is the most reasonable alternative. The <br />proposed action meets the purpose and need of the project, as described in section 5.1 of <br />the EA. I have determined that this action will not have significant impacts on the human <br />environment, and an EIS is not required. This decision is consistent with established uses <br />of BLM Land, and is in conformance with the current San Juan/San Miguel Resource <br />Management Plan, which states on page 17: <br />"BLM actively encourages and facilitates the development by private <br />industry of public land mineral resources so that national and local <br />needs are satisfied and economically and environmentally sound <br />exploration, extraction, and reclamation practices are provided. " <br />"BLMs land use plans and multiple use management decisions will <br />recognize that mineral exploration and development can occur <br />concurrently or sequentially with other resource uses. " <br />"Mineral exploration and development on public land will be <br />regulated under 43 CFR 3800 to prevent unnecessary and undue <br />degradation of the land.
