BASIC TERMS AND CONDITIONS -- ALL FACILITIES (cont.) <br />2) Permittee Review/Change: The peramittee shall amend the plan whenever there is a change in design, construction, <br />operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to the <br />waters of the State, or if the SWMP proves to be ineffective in achieving the-general objectives of controlling <br />pollutants in stormwater discharges associated with mining activity. If existing BMPs need to be modified or if <br />additional BMPs are necessary, the plan changes and implementation must be completed before the next <br />anticipated storm, or not more than 60 days after: the change in design, construction, operation, or maintenance, <br />or, the SWMP has been determined to be ineffective, unless this time frame is extended by the Division. <br />Amendments to the plan shall be summarized in the Annual or Compliance Report. The Division reserves the <br />right to require additional measures to prevent and control pollution, as needed. <br />Prohibition of Non-stormwater Discharges <br />Except as provided in paragraph b, below, all discharges authorized by this permit shall be composed entirely of <br />stormwater. Discharges of water other than stormwater must be addressed in a separate CDPS permit issued for that <br />discharge. <br />b. Discharges from the following sources that are combined with stormwater discharges associated with mining activity <br />may be authorized by this permit, provided that the non-stormwater component of the discharge is identified in the <br />SWMP (see Part IJ3A.g of the permit): fire fighting activities, uncontaminated compressor condensate, irrigation <br />drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, and foundation or footing <br />drains where flows are not contaminated. <br />4. Releases in Excess of Reportable Ouantities <br />This permit does not relieve the permittee of the reporting requirements of 40 CFR 110, 40 CFR 117 or 40 CFR 302. Any <br />discharge of hazardous material must be handled in accordance with the Division's Notification Requirements (see Part <br />ILA.3 of the permit). <br />5. Facility Inspections <br />a. Active Mining Operations. In addition to the inspections necessary to comply with the preventive maintenance <br />program requirements in Part I.B.4.c, qualified personnel identified by the permittee shall make a thorough inspection of <br />their stormwater management system, at least twice per year (in the spring and fall). Where semi-annual site inspections <br />are shown in the plan to be impracticable because an employee is not stationed at or does not routinely visit the site, <br />inspections as required in this part shall be conducted at appropriate intervals specified in the plan, but never less than <br />once in two years. These inspections must be documented and summarized in the Annual Report . (see Part I.E.1 of the <br />permit). <br />b. Inactive Mining Operations. Qualified personnel identified by the permittee shall make a thorough inspection of their <br />stormwater management system, at least once per year. Where annual inspections are shown in the plan to be <br />impracticable, because an employee is not stationed at or does not routinely visit the site, an inspection is required at <br />least once every three years by a Registered Professional Engineer. The inspector must certify that the site is in <br />compliance with the plan. If the site is not in compliance with the plan, it must be brought into compliance, reinspected, <br />and plan compliance then certified by the inspector. These inspections must be documented and summarized in the <br />Compliance Report (see Part I.E.1 of the permit). <br />c. Remediation Operations. Qualified personnel identified by the permittee shall make a thorough inspection of their <br />stormwater management system, at least once per year (in the field season). Where annual site inspections are shown in <br />the plan to be impracticable, because an employee is not stationed at or does not routinely visit the site, inspections as <br />required in this part shall be conducted at appropriate intervals specified in the plan, but never less than once in two <br />years. These inspections must be documented and summarized in the Annual Report (see Part I.E.1 of the permit).
