• Sunday Mines Air Permit - CDPHE - 07SM1140
Regulatory Agency: Colorado Department of Health and Environment, Air Pollution Control Division
("Division")
Date: June 20, 2008
Renewal Date: November 6, 2012
Permitted Source: Discharge into the atmosphere from underground uranium and vanadium mine
ventilation systems.
1) Commence constructions/modification or operation within 18 months after issuance of permit
(December 2009), or commences construction pursuant to permit application.
2) Within 180 days of commencement of operations, self certify compliance with conditions.
3) Visible emissions shall not exceed 20% opacity during normal operation of the source.
4) During periods of startup, process modification, or adjustment of control equipment visible emissions
shall not exceed 30% opacity for longer than six minutes in any sixty consecutive minutes.
5) Opacity shall be measured by EPA method 9 (Regulation No. 1, Section II.A.I & 4.)
"Section II.A.I - Smoke and Opacity.
The previous opacity regulations have made ?LnLexceedence of 20% opacity a violation. To
conform to the method of opacity measurement used by the U.S. Environmental Protection
Agency, the commission has switched to the 6-minute averaging method of measuring opacity
• contained in EPA Method 9 (40 CFR, Part 60, Appendix A (July, 1992)). The testimony
presented by division representatives indicated investigators in the field have in effect been
averaging opacity. The commission encourages the division to continue its practice of allowing
non-agency personnel to attend smoke school and receive certification."
"Section II.A.4 - Fire Building, Cleaning of Fire Boxes, Soot Blowing, Start-Up, Process
Malfunction or Adjustments of Control Equipment.
On the same rationale that the limited exception for pilot plants was amended (see comments on
II.A.3. above), the limited exceptions for these sources has also been changed from up to three
minutes in a 60-minute period at no more than 40% opacity to up to six minutes at 30% opacity
(averaged)."
EPA method 9 attached.
6) Emissions of Air pollutants shall not exceed the following limitations:
a) Particulate matter: 13.74 Tons per year
b) PM 10 (Particular matter <10pm): 13.74 Tons per year
7) A revised Air Pollutant Emission Notice (APEN) shall be filed (Regulation No. 3, Part A, Section
II.C.):
a) Annually whenever a significant increase in emissions occurs as follows:
i) For any criteria pollutant:
• (1) For sourced emitting less than 100 tons per year, a change of five tons per year or more,
above the level reported on the last APEN submitted.
