3.0 Environmental Protection Measures and Monitoring <br />• Required by Other Agencies <br />The following sections identify the environmental protection measures and <br />monitoring requirements by other agencies, and a list of permits and licenses. <br />3.1 Environmental Protection Measures and Monitoring by <br />Statute, Regulation or Permit <br />The Sunday Mines comply with federal, state, and local laws and regulations. The <br />Sunday Mines are also consistent with Rangeland Health Standards and Guidelines <br />and do not affect any tribal lands held in trust for the tribes by the federal <br />government. More than three dozen federal environmental laws and regulations <br />apply to all aspects of mining at the Sunday Mines Group. The following are the <br />major laws governing mining. <br />¦ Surface Resources Act at 43 CFR subpart 3715 - regulates residency or <br />seasonal occupancy of mining claims by mining claimants and requires <br />occupancy to be authorized by the proper BLM field office through a notice or <br />plan of operations. <br />¦ Federal Mining Law at 43 CFR subpart 3809, Surface Management Program <br />- requires proper permits and authorizations for mineral exploration mining, <br />and reclamation actions on the public lands administered by BLM. <br />¦ National Environmental Policy Act - requires interdisciplinary approach to <br />environmental decision making. <br />¦ Federal Land Policy and Management Act - requires the prevention of undue <br />and unnecessary degradation of federal lands. <br />¦ Clean Air Act - sets air quality standards. <br />¦ Federal Water Pollution Control Act (Clean Water Act) - directs standards to <br />be set for surface water quality and for controlling discharges to surface water. <br />¦ Safe Drinking Water Act - directs standards to be set for quality of drinking <br />water supplied to the public (states are primary authorities) and regulates <br />underground injection operations. <br />¦ Solid Waste Disposal Act - regulates the generation, storage and disposal of <br />hazardous waste and management of solid, non-hazardous waste. <br />¦ Endangered Species Act - mandates protection for plants and animals listed <br />that are threatened or endangered. <br />r? <br />3-1 <br />7:184988-Denison Mines\Task Order 4 - EPP Sunday Mines GroupTINAL EPPTINAL - Environmental Protection Plan Sunday Mines.doc
