reclamation is expected to end three years thereafter. The plan would allow Cemex to continue <br />storing surface runoff in the quarry pits for use hi dust suppression in addition to using C-BT <br />water directly. <br />Cemex believes that the water collected and stored in the limestone and shale pits <br />consists entirely of surface water runoff and no appreciable amount of groundwater is exposed or <br />captured in the pits. Cemex claims the right to store water in the quarry pits under its storage <br />right, decreed in Case No. 83CW374 ("D owe Flats Storage Right"), when in priority or as <br />otherwise allowed under § 37-80-120(1), C.R.S. (2008) (allowing upstream out-of-priority <br />storage). Captured water that may not be stored under Cemex's Dowe Flats Storage Right will <br />be replaced through a surface water substitution or exchange approved by the State Engineer in <br />accordance with § 37-80-120(2), C.R.S. (2008). Cemex owns 457 C-BT units (class C for <br />multipurpose use) that may be used a source for substitution. <br />1. Replacement of i4,ater currently stored. <br />Three limestone quarry pits in Dowe Flats have collected surface water runoff out-of- <br />priority and may require replacement by exchange into the St. Vrain if Cemex's Dowe Flats <br />Storage Right does not come into priority this spring.
