al. A <br />that all prior communication with the DRMS (and predecessor DMG) had no mention of a lack of this document. It <br />was and is our understanding that construction of the slurry wall alleviated the need for a well permit since groundwater <br />was no longer being exposed to evaporation. It is our understanding that Central was responsible for a well permit if <br />one was required. Upon your notification and requests in the April 2009 inspection report, we have contacted the <br />Central Colorado Water Conservation District regarding the need for a well permit. As that permit is related to Weld <br />County Public Works' mining activities, we and Central have agreed that the County will prepare that permit and <br />submit it along with the SWSP being prepared by Central Colorado. As above, we and they request that an extension <br />period of 90 days be granted to allow preparation of the SW SP and well permit to allow sufficient time for the Colorado <br />Division of Water Resources, State Engineers Office to review and comment on that SWSP. <br />Item #3 states that the DRMS has not received copies of the CDPHE discharge permit. The Koenig pit has been <br />covered under a CDPHE general permit, number COG-50-0182. A copy is attached. <br />Item #4 states that the inlet/outlet structure for the Koenig reservoir has not been included in the approved Reclamation <br />Plan and requests a Technical revision be submitted to the DRMS. Attached please find the construction drawings for <br />that structure built by Central. As shown on the drawings, this structure was designed for and constructed by the <br />Central Colorado Water Conservation District in conjunction with the DRMS approved revision to the 2nd amended <br />reclamation plan. As the inlet/outlet structure relates to the operation of the water storage aspects of the site, Central <br />Colorado Water Conservation District may have additional details that they can submit upon request. <br />If you have any questions or need additional information, please feel free to contact me or Clay Kimmi at (970)304- <br />6496.
