The permit revision was reviewed and eventually approved by the <br />Division on February 1, 1991. <br />Pursuant to Rule 2.08.5, the Division, on October 6, 1993, notified Energy Fuels Coal, <br />Inc. of the need to renew the permit in a timely manner. The Division received the <br />renewal application on February 10, 1994. The application was deemed complete on <br />February 14, 1994. The adequacy review was in two phases, with completed review by <br />June 20, 1994. Response to the first phase of the adequacy review was on March 31, <br />1994. Response to the second phase was begun in April 1994 with completion on June <br />16, 1994. A third component of the permit renewal, bond evaluation was begun in April <br />1994 and completed on June 17, 1994. Final approval of the renewal occurred on June <br />20, 1994. <br />Pursuant to Rule 2.08.5, the Division, on 8 October, 1998, notified Energy Fuels Coal, <br />Inc. of the need to renew the permit in a timely manner. The Division received the <br />renewal application on 31 January 1999. The renewal application was deemed <br />complete on 2 February 1999 and a preliminary adequacy letter was sent out on 21 <br />June 1999. The responses to the adequacy were received on 14 May 2001. Final <br />approval of the renewal occurred on 22 June 2001. <br />Pursuant to Rule 2.08.5, the Division, on 31 October 2003, notified Energy Fuels Coal, <br />Inc. of the need to renew the permit in a timely manner. The Division received the <br />renewal application on 16 January 2004. The renewal application was deemed <br />complete on 26 January 2004 and a preliminary adequacy letter was sent out on 27 <br />April 2004. The responses to the adequacy were received on 20 May 2004. A second <br />adequacy letter was sent to EFCI on 21 June 2004. This letter regarded resolving <br />stipulations 4, 6, 14, 15 and 18. Responses to this letter were received on 22 July <br />2004. Final approval of the renewal occurred on 10 September 2004. <br />Pursuant to Rule 2.08.5, on October 7, 2008, the Division notified EFCI of the need to <br />renew the permit and that a complete application for renewal must be received by the <br />Division by January 31, 2009. The Division received the renewal application on <br />January 30, 2009 and the application was called complete on the same day. A <br />preliminary adequacy letter was forwarded to EFCI on March 30, 2009 indicating the <br />Division found no deficiencies or inadequacies in the existing permit application. <br />The Division currently holds a surety bond from National Union Fire Insurance <br />Company in the amount of $380,431.00. The current estimated cost for the Division to <br />complete reclamation at the Southfield Mine, in the event of bond forfeiture, is <br />$223,856.00. The current bond amount of $380,431.00 was set statutorily through the <br />Phase I Bond Release SL-02 and cannot be decreased without the submittal and <br />approval of another bond release. <br />Mine History and the Environment <br />The Southfield Mine is located approximately 8 miles south of Florence, Colorado in <br />Fremont County. The mine can be reached by driving south from Florence via <br />Page 4 of 36
