Water Rights and Usage <br />Although EFCI currently has the legal right to utilize water from the Corley Mine Well for <br />mining, processing and related operations, as part of the reclamation activities, the <br />water line has been cut and sealed and the fresh-water pond has been reclaimed. <br />Records taken over the last 25 years suggest no negative impacts or reduction in flow <br />have occurred from Southfield's use of the water from this well. <br />Stipulation No. 20, written in response to address the North Dewatering Well, was <br />issued in 1993 as part of the Mid-term Review. This stipulation committed EFCI to <br />either obtaining a permit for the North Dewatering Well or developing a closed-loop <br />system for keeping the water underground, in effect closing the well and re-routing the <br />water into other mine workings. The Division received a letter dated May 23, 1994, <br />which stated EFCI's intention to develop a closed-loop system. Technical Revision <br />No. 19, received on June 16, 1994, committed EFCI to this plan. Technical Revision 19 <br />was approved by the Division on 24 October 1994. Stipulation No. 20 has been <br />terminated. In response to landowner concerns regarding the water quality of the mine <br />water and with the approval of Technical Revision 35, the North Dewatering well was <br />converted to a monitoring well. <br />Page 12 of 36
