If the responses could be incorporated into a revised permit page (or pages) and <br />sent to us, then the only technical adequacy issue I see remaining is the SHPO clearance. I believe Shina Duvall at the <br />Colorado Historical Society is expected back in her office today. I will give her a call, and discuss the project with her <br />today, if she's available. Hopefully she can provide the clearance by this Friday. <br />The as-built for the MR-354 Light-use Road, once it is prepared, should be submitted as a Minor Revision to the West Elk <br />permit. This is so the as-built may serve as the Light-Use Road designs required by our rules. Please provide this <br />commitment in a revised permit page, and describe in the revised permit page where in the permit (Exhibits, etc) the as- <br />built will, in the future, be located. <br />We are preparing the information needed for our Minor Revision Decision Form, and would appreciate your assistance <br />as discussed below: <br />• 1 believe the pages of the West Elk Mine permit that (at this stage) are to be revised are 2.05-15, 2.05-16, 2.05- <br />17, 2.05-28, and 2.05-29. Please let us know if our list agrees with MCC's list. If the revised permit pages <br />requested in the first part of this e-mail changes this list, let us know that as well. <br />MCC should propose a method to incorporate the May 5, 2009 Barr Engineering Memorandum (and its <br />accompanying two Figures) from Paul Swenson, Jed Greenwood, and Brad Dunn to Chris Nyikos and yourself <br />into the West Elk Permit. This could be done by submitting the memo as a new Exhibit to the permit, or a new <br />Appendix, or some other such new addendum. Please let us know how this memo and its two figures will be <br />incorporated into the West Elk Permit, and provide any necessary cover/title page that might precede the memo <br />in the Permit. <br />I believe the proposed acreage for new disturbance is 0.6 acres, all on private land, with no increase in permit <br />area. Please let us know if these statements are correct. <br />• Tom Kaldenbach calculated the reclamation liability for the light-use road and the 10 boreholes at $8,820 before <br />he left. Please let us know if this value meets with MCC's satisfaction.
