T <br /> III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br /> of Reclamation, Mining and Safety on May 13, 2009. Chuck Silengo of McClane Canyon Mining was <br /> present during the entire inspection. Weather conditions were clear and warm. Ground conditions <br /> were mostly dry. <br /> Coal was being loaded and hauled from the mine at the time of the inspection. During this and recent <br /> previous inspections it was noted that the coal stockpile has become significantly larger than usual and <br /> coal was piled almost to the limit of the disturbance boundary markers to the north. To ensure <br /> compliance,please be aware of the disturbance boundary and do not allow coal material to be placed <br /> beyond the disturbance boundary markers. <br /> Roads <br /> Roads were maintained and in good condition throughout the site. Ditches and culverts were clear of <br /> sediment and debris and functioning properly. <br /> Hydrologic Balance <br /> Drainage structures and diversion culverts in the portal area were clear of debris and appeared to be <br /> functional. The mine was not discharging water at the time of the inspection. The sediment pond was <br /> containing muddy water below the level of the principal spillway. The pond embankment, inlet and <br /> discharge structures are stable with no problems noted. <br /> Processing_Waste <br /> The temporary coal waste pile area was inspected and found to be properly maintained. The berm <br /> around the waste pile is well maintained and the clean water diversion around the waste pile is stable <br /> and functional. <br /> Support Facilities <br /> The shop and facilities areas were well kept. Perimeter areas at these locations were maintained, and <br /> no problems were noted at the shop or facilities area during this inspection. <br /> Air Resource Protection <br /> At the time of the inspection, MCM was watering roads for dust suppression. <br />
