Compliance with Other Laws <br />1. The Colorado State Historical Preservation Office (SHPO) determined that a <br />historical and archeological survey were needed for the proposed borrow facilities <br />and associated facilities near Hesperus, Colorado. A survey was conducted by <br />Complete Archeological Service Associates (CASA) on June 25 and 27, 1999. <br />Cultural resource clearance was recommended for the remainder of the subject land. <br />CASA's report is attached following this summary page. Also attached is SHPO <br />letter declaring that none of the sites documented during the CASA study qualify for <br />inclusion in the National Register of Historic Places. <br />2. 402 Certification (Discharges Associated with Sand & Gravel Production Operations) <br />to discharge into the La Plata River (from the Colorado State Department of Health <br />and Environment - Water Quality Division) is currently being processed for this <br />project. <br />3. A Gravel Pit Well Permit (from the Colorado State 1?naineer's Office) is currently <br />being processed for this project. The well application packet will include a <br />Supplemental Water Plan for the project which will stay in effect until mining activity. <br />is completed at the site. <br />4. The applications for the Colorado Department of Health, Air Pollution Control <br />Division, Air Pollution Emission Permit and Fugitive Dust Permit is currently being <br />processed for this project. <br />5. Federal Agencies (other than the Corps, see below) were not contacted because the <br />activities are proposed on private property (Greer Property). <br />6. A wetland delineation on the subject property was conducted in July 1999. <br />Verification of the wetland boundaries by the USACOE is pending. As planned, the <br />proposed gravel pit and processing area will have no effect on the wetlands as <br />mapped. However, the proposed crossing of the La Plata River will impact Waters of <br />the US and associated riverine wetlands. A USACOE Nationwide Permit #14 will be <br />processed for authorization of this activity. <br />7. Nielsons Inc. and Sugnet and Associates are currently guiding this project through La <br />Plata County's Class II Land Use permitting process. <br />8. Sugnet and Associates conducted a threatened and endangered species survey on this <br />property in July 1999. No threatened or endangered species nor their critical habitat <br />were located during this survey. Endangered species; clearance is recommended for <br />the proposed project.
