<br />PROPOSED DECISION
<br />The Colorado Division of Reclamation, Mining and Safety proposes to approve an application for a
<br />partial Phase One Bond Release (Surety Release SL-3) submitted by Bowie Resources LLC for the Bowie
<br />No. 1 Mine, Permit Number C-1981-038. The proposed decision is based on successful completion of
<br />structural demolition and removal at the Bowie No. 1 Mine unit train loadout. The mine is an
<br />underground coal operation located in Delta County approximately four (4) miles north of Paonia,
<br />Colorado, with the loadout located approximately one (1) mile east of Paonia, Colorado. The permit area
<br />contains approximately 8,670 acres of land within the following sections:
<br />Township 13 South, Range 92 West, 6th P.M.
<br />Sections: 1, 2, 10, 11, 12, 13, 14, 15, 22, 23, 24 and 25
<br />Township 13 South, Range 92 West, 6`h P.M.
<br />Sections 5, 6, 7, 8, 17, 18, 19, 29, 30, 31 and 32
<br />The permit area is contained within the U.S. Geological Survey 7.5 minute Bowie and Gray Reservoir
<br />Quadrangle maps.
<br />In the partial Phase One Bond Release, the Division is proposing to release a total of $1,136,354.00 for
<br />structural demolition and disposal offsite of most of the facilities at the unit train loadout, as detailed in
<br />the Division's Proposed Decision and Findings of Compliance for the Partial Phase One Bond Release.
<br />This amount is 60 percent of the reclamation liability for the structural demolition tasks performed at that
<br />site. There is enough reclamation bond money retained to perform the remaining reclamation tasks at the
<br />Bowie No. 1 Mine.
<br />A copy of the "Proposed Decision and Findings of Compliance" is on file for public inspection at the
<br />Colorado Division of Reclamation, Mining and Safety, Room 215 Centennial Building, 1313 Sherman
<br />Street, Denver, Colorado 80203, at the Paonia Public Library, 140 Grand Avenue, Paonia, CO 81428 and
<br />at the Delta County Clerk's Office, 5th & Palmer, Delta, CO 81416. Any person with a valid legal
<br />interest which might be adversely affected by this proposed decision may request a formal public hearing
<br />before the Mined Land Reclamation Board in accordance with Rule 3.03.2(6). Requests for a public
<br />hearing must be received by the Division within thirty days of the first publication in the Delta County
<br />Independent. The request must be in writing and must state, with reasonable specificity, the reasons for
<br />requesting such a hearing. All requests must be submitted to the Colorado Division of Reclamation,
<br />Mining and Safety, 1313 Sherman Street, Room 215, Denver, Colorado, 80203. If no hearing is requested
<br />within those thirty days, the Division's decision will become final.
