My office recently submitted comments to you in regard to the project submitted by Peabody Coal Company and
referenced above. In that letter we recommended that no work on this project occur prior to July tin order to
protect nesting and brood rearing habitat for Columbian sharp-tailed and Greater sage grouse. Recently a site visit
to the project location was conducted by Mr. Rick Hoffman. Mr. Hoffman is a former employee of the Colorado
Division of Wildlife and a recognized expert on grouse biology. As a result of his site visit Mr. Hoffman believes
that the area to be impacted by this development, while within the recognized buffer area recommended for the
protection of sharp-tailed and sage grouse nesting and brood rearing habitat, is not suitable for those purposes
because of past farming and ranching practices at the site. In light of this new information I now believe that work
at this location can proceed prior to July 1 without the likelihood of disturbance to either of the grouse species.
