III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator, Minrec,Inc., during the inspection. The inspection was limited in scope due to the presence of sheep <br /> and their guard dogs on site. <br /> Roads <br /> The county road up Hubbard Creek canyon was dry and in good condition. Gravel had been recently spread on <br /> the road in several locations.The light use road across Hubbard Creek that accesses the reclaimed main mine <br /> site was dry and passable,as was the light use road that leads to reclaimed pond 5. <br /> Hydrology <br /> The upper diversion ditch behind and above the reclaimed coal stockpile area was well vegetated and had <br /> sufficient capacity. <br /> Signs and Markers <br /> The mine id sign and the records location sign were attached to the main mine entrance gate. Surface <br /> disturbance markers were up around the disturbed area. <br /> Reclamation <br /> The reclaimed main mine site had a good vegetative cover, although the sheep were grazing on the slopes.There <br /> was no indication of the presence of slides or other slope stability issues with the reclaimed slopes. Also,there <br /> were no problems with erosion on the slopes. <br /> There also were no problems at the reclaimed coal stockpile area. However, several plastic 18 inch diameter <br /> culvert sections are still on site and need to be removed. <br /> The reclaimed pond 4 area is just starting to green up.The vegetation,however, is very sparse at this time. The <br /> silt fence was in place, as it also was at reclaimed pond 5.There was no evidence of erosional gullying. <br /> There were no stability problems with the reclaimed haul road. <br /> Piezometers and survey stakes are still unreclaimed. <br /> c:/word2007/blueribbon/insp0509 <br />
