III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the inspection. <br /> Signs and Markers <br /> The mine id signs were up at the three locations;one at the main entrance, one at the east entrance and one by <br /> the railroad crossing. Perimeter markers were also up around the site. <br /> Roads <br /> The paved main haul road was in good condition. The graveled east entry way was also in good condition. The <br /> east gate was open. The dirt road adjacent to the railroad tracks was passable. <br /> Facilities <br /> There were small stockpiles of coal on the facilities bench,except for the coal fines stockpile,which was <br /> somewhat large. The coal fines stockpile will be trucked back to Oxbow's Elk Creek Mine later in the week. <br /> Coal haul trucks were unloading and coal rail cars were being loaded during the inspection. Although there was <br /> considerable wind occurring during the inspection,there were no fugitive dust problems observed. <br /> There were no problems observed at the material storage area,the substation,truck weigh station and the <br /> loadout office.Also,there were no indications of problems at the coal haul truck unloading structure, crushing <br /> and screening structures and coal railcar loading structures. <br /> Hydrology <br /> There was only a little standing water in the east sediment pond. The pond's embankment was stable and well <br /> vegetated, as were the pond's inslopes.The primary discharge pipe gated valve was closed and the emergency <br /> spillway had sufficient capacity. Straw bales and silt fence were in place at the railroad track small area <br /> exemption. Water was flowing through the private ditch that runs on the west side of the loadout property. <br /> Topsoil Stockpiles <br /> The two topsoil stockpiles had good vegetative cover. There were no signs of erosional problems. The topsoil <br /> signs were in place on each topsoil stockpile. <br /> Noxious Weeds <br /> There were only a few occurrences of whitetop at the loadout and they were mainly in the grassy areas north of <br /> the facilities bench. The operator arranged to have the weeds sprayed. There were virtually no occurrences of <br /> white top anywhere else. The operator has done a good job of controlling noxious weeds on the site. <br /> c:/word2007/terror/inspO5O9 <br />
