4 III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator during <br /> the field inspection.Bill Bear represented the operator for the records check. <br /> Roads <br /> The paved entrance road was in good condition.There was no debris on the road from the adjoining private property.The <br /> cable guard was up on the outer edge of the road.The bridge across the North Fork of the Gunnison was passable. Two <br /> boards on the east side of the bridge are loose and might need repair in the future if it gets worse. <br /> Signs and Markers <br /> The mine id sign and its post were on the ground and need to be put back up. Surface disturbance markers were up around <br /> the disturbed area.The"no trespassing"sign was attached to the mine's entrance gate just past the east side of the bridge. <br /> Facilities <br /> The entrance gate to the mine was open.Almost all of the debris from the demolished mine office has been removed from <br /> the site.Concrete sections and a portion of the concrete pad remain at the site. <br /> HydrologX <br /> There was a fairly large volume of water in the sediment pond,right up to the primary pipe.Also,there was standing water <br /> in the collection ditch that leads to the sediment pond.This water in the pond and ditch is probably associated with the high <br /> water level of the adjacent North Fork of the Gunnison River.The gated valve on the pond's primary pipe was in the closed <br /> position.There was no discharge from the pond.The pond's emergency spillway had sufficient capacity. <br /> The hillside spring water treatment pond was discharging at about 10 to 15 gpm through the black plastic pipe and into the <br /> river.The color of the pond discharge was orange but has been found to be in compliance.The hillside spring was flowing <br /> into its constructed channel and through the culvert that leads to the treatment pond.There were no problems with the <br /> alluvial wells or the riverside berm. <br /> Reclamation <br /> The reclaimed portal access road was stable and well vegetated.There was no water coming out of the black plastic <br /> underdrain pipes. The reclaimed fan portal site on the east side of the site was also stable and well vegetated. <br /> The portal area on the west side of the mine site continues to show some instability,although the original unstable area has <br /> been covered over by dirt that has fallen from above.The newer unstable area just to the east of the original unstable area <br /> continues to show cracking and a little slumping in the cliff area.There was no indication of vapor or the odor of <br /> smoldering coal in the area. <br /> Noxious Weeds <br /> What appears to be a considerable amount of white top is growing on the facilities area and along the lower section of the <br /> reclaimed portal access road.The white top needs to be sprayed immediately.There were only a few scattered thistle plants <br /> beginning to grow around the site and should be sprayed soon.Tamarisk continues to grow along the water's edge of the <br /> hillside spring water treatment pond and at the outlet area of the hillside spring and needs to be treated appropriately. <br /> Records <br /> The mine records are located at the Bowie No.2 Mine and were in compliance. <br /> c:/word2007/bear3/insp0509 <br />
