III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented the <br />operator, Bowie Resources LLC, during the inspection. The longwall was still down and is not anticipated to <br />restart until sometime in June. There is limited development mining due to methane problems in the mine. <br />Gob Vent Borehole Reclamation <br />Several reclaimed gob vent borehole pads over the west district mining were inspected. The borehole pads were <br />for gob vent boreholes WD-2b, WD-2c, WD-3c, B-la, B-lb, B-2b, B-2c, B-2d, B-2e and B-3c. The reclaimed <br />pads and mud pits had been backfilled and graded, re-topsoiled and seeded. All of the pads had good vegetative <br />cover. The reclaimed drill hole locations were properly marked with stakes. The reclaimed sites look good. <br />Several subsidence monuments were inspected along the roads that led to the reclaimed gob vent borehole pads. <br />The monuments consist of rebar hammered into the ground and, in most cases, capped with the surveyor's <br />identification. The locations were marked with stakes or flagging. No problems were noted with the monuments. <br />Hubbard Creek Vent Shaft Area <br />The emergency escape hoist has been constructed over the vent shaft. The operator is also starting to reclaim the <br />mud pit on the pad. It will take some time to complete the project since the mud pit is very slow in drying out. <br />The upland diversion ditch above the pad is functioning properly. <br />The berm on the outer edge of the pad is in place and two rows of straw bales were placed across the pad's <br />lower entrance ramp. This ramp will, eventually, be taken out so that the only entrance to the shaft pad will be <br />from the north. Surface disturbance markers and the mine id sign were up. Silt fence was up between the road <br />and Hubbard Creek. <br />Main Mine Site <br />There was almost no coal at the coal stockpile bench at the bottom of the hill. Bowie Resources is still receiving <br />coal from the West Elk Mine, washing the coal for West Elk, and shipping the coal out by rail, with the coal <br />waste going back to West Elk. <br />The paved main haul road was in good condition. The guard rail was in place. There was a fair volume of <br />standing water in pond B across the county road from the coal stockpile bench. The pond's embankment <br />appeared to be stable. The mine id sign was up at the mine entrance and contained the required information. <br />The cut and fill slopes of the mine facilities benches were stable and well vegetated. The surface disturbance <br />markers were up around the disturbed area. The main topsoil stockpile was well vegetated and showed no signs <br />of erosional gullying. Topsoil signs were up. There was very little coal that was stockpiled on the D-seam portal <br />bench. The mine facilities appeared to be in order. <br />c:/word2007/bowie2/insp0509
