Cattany <br />Division Director <br />Natural Resource Trustee <br />Mountain Coal Company, the operator of the West Elk Mine located in Gunnison and Delta Counties, <br />Colorado, proposes to construct a 1330-foot light use road and drill 8 geotechnical data boreholes within <br />the existing mine permit area at locations that have not been previously approved by the Division for <br />disturbance. Because these activities will create new disturbances, we are requesting,that your agency <br />determine whether the proposed disturbances will adversely affect a place that is listed on, or is eligible <br />for listing on, the National Register of Historical Places. We make this request pursuant to the May 1991 <br />Memorandum of Understanding (MOU) between our agencies. <br />The proposed new disturbance will be a total of 0.6 acres. The disturbances are proposed to be located in <br />Section 15 of Township 13 South, Range 90 West, 6th P.M., Gunnison County, Colorado, as shown on <br />the enclosed map. <br />In order that we may comply with regulatory timeframes, we request comments be submitted to our office <br />by Friday, May 22, 2009. <br />If you have any questions, please contact me at 303-866-3567, extension 8126. <br />Sincerely, <br />4 <br />Daniel I.
