amount of backfilling required on site, and the configuration of the slurry walls. No <br />additional information regarding the proposed extent of mining was submitted with the <br />TR. <br />• Access/damage waiver agreements will need to be revisited due to the proposed changes <br />in access to existing features, and the proposed modifications required to raise several <br />features to a new post-mining final elevation. Also the proposed reservoir configuration <br />seems to include several utility crossings within the reservoirs themselves that did not <br />previously exist. <br />• The slurry walls that have already been installed no longer conform to the proposed final <br />reservoir configuration. <br />There are other technical considerations that will have to be addressed before this change could <br />be approved by the Division, but the intent of this letter is not to serve as a full technical review. <br />This letter is also not intended to say that the Division would not ultimately approve this type of <br />reconfiguration, only that the scope of these proposed changes is well outside what would <br />typically be considered under a technical revision. <br />Gilcrest may withdraw the request to change the mining sequence and final reclamation <br />configurations of the reservoirs as proposed under this TR within 30 days and the TR fee of <br />$216.00 will be returned. Otherwise, at the end of 30 days (June 6, 2009) the TR will be denied, <br />and the fee will not be refunded. <br />If Gilcrest LLC wishes to submit an application for a permit amendment to incorporate these <br />proposed changes, they should first complete the succession of operator (SO) process according <br />to section 1.12 of the Construction Materials Rule, so that they are the permittee of record for the <br />Platte Sand and Gravel permit. After the SO process has been completed, the permittee should <br />refer to Section 1.10 - Amendment to a Permit in the Construction Materials Rule for the <br />required procedure and fees for amending the permit.
