(Page 4) <br />MINE ID # OR PROSPECTING ID # M-1983-102 <br />INSPECTION DATE 04/16/09 <br />INSPECTOR'S INITIALS PSH <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective <br />actions) were identified during this inspection. The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTIVE DATE <br />7/13/09 <br />1. PROBLEM: <br />PB or PV:PB <br />The operator failed to salvage approximately 650 cubic yards of TOPIC(S):TS <br />topsoil and overburden during the most recent mining activity. <br />CORRECTIVE ACTION: <br />The operator is required by the original reclamation permit to <br />salvage all topsoil and overburden material available onsite. <br />During the September 5, 2006 inspection, the Division estimated <br />18,550 cubic yards of topsoil would be required to reclaim the <br />site. The amount of topsoil stockpiled on site has been <br />estimated at 12,000 cubic yards. <br />To avoid a possible violation, the operator must either: <br />1. Provide documentation there is enough available topsoil <br />material to re-topsoil the site to an average of six inches <br />of topsoil per the approved reclamation plan. <br />Or <br />2. If the topsoil is not available on site, increase the <br />financial warranty to imported the required topsoil to <br />complete the required reclamation at the site. The Division <br />estimates the total cost to reclaim the site is $147,900.00. <br />The estimate includes the cost to import 650 cubic yards of <br />topsoil to replace the un-salvaged amount, demolition of the <br />concrete batch plant and removal of the concrete, rock and <br />asphalt stockpiles. <br />I, Peter Hays, hereby certify that on May 13, 2009, I deposited a true and complete <br />copy of this foregoing inspection report in the United States Mail, first class <br />postage paid, to the operator of record for this site at the address indicated, and <br />to those others within the body of this report who have been designated to receive <br />copies (DRMS personnel excepted). /f <br /> <br />Signature
