If any "reportable quantity" of hazardous material or waste is released into the <br />environment, the operator will notify staff of the Colorado Division of Minerals and <br />Geology as well as all other appropriate local, state and federal agencies. This is more <br />completely described by an excerpt from the February 8, 2002 DRMS memorandum <br />regarding Minerals Program Notification of Toxic or Hazardous Materials Spills at Mine <br />Sites. <br />"A reportable spill is a spill of any toxic or hazardous substance (including spills of <br />petroleum products) within the permit area reportable to any Division of the Colorado <br />Department of Public Health and the Environment, the National Response Center, the <br />Colorado Emergency Planning Committee, or the State Oil Inspector. The operator shall <br />notify the Office of the reportable spill within the permit area using the same timeframe <br />required by the permit, license, notice, Act, Rule or Regulation governing the reporting of <br />the spill to the appropriate agency. Notice of a reportable spill shall be faxed to: Minerals <br />Program Supervisor, Division of Reclamation, Mining and Safety, FAX (303)832-8106. <br />The FAX shall include a call-back number of a responsible company official for the <br />DRMS staff to use as a contact." <br />In the event that Rio Blanco County needs to bring other facilities onsite for the <br />operations, the Division of Reclamation, Mining and Safety and Rio Blanco County will <br />be contacted with a Technical Revision to allow for these facilities to be onsite. All other <br />necessary permits through state organizations will also be obtained on a case by case <br />basis as required for each facility <br />5. Water Information. Rights and Augmentation <br />All water rights issues such as availability of water for this operation, consumption rates, <br />dust control, etc. is presented in Exhibit G - Water Information. <br />6. Schedule of Operations <br />Mining operation will occur as dictated by demand. Mining and screening/washing <br />activities will take place year round and product will be sold from this site throughout the <br />year, although little is expected to be sold in winter months. The operator does not expect <br />to have any night gravel operation. <br />7. Rio Blanco County Impacts and Environmental Impacts <br />The impacts to Rio Blanco County will be limited. Minimal dust is expected since the <br />roads and Pit will be watered as needed. The pit will be accessed from a new access on <br />Rio Blanco County Road No. 122. Traffic is expected to enter the county road to then <br />travel to the various surrounding locations to provide for the needs of the road <br />maintenance and construction in the Piceance Creek Basin and surrounding area. No new <br />impacts to county services will occur. The long term effect of the operation will be <br />beneficial to the environment by providing an aesthetically pleasing lake with a wetland <br />fringe that will provide foraging, nesting, and cover habitats for numerous species of <br />12
